About the state institution "The Machinery of the Akim of Shymkent"
I. General provisions
1.1. The state institution "The Machinery of the Akim of Shymkent", hereinafter referred to as "State institution" is a noncommercial organization founded for execution of informational-analytic, organizational-legal and material-technical support of activity of akimat and akim of Shymkent.
1.2. The Machinery executes its activity in accordance with the Constitution of the Republic of Kazakhstan, with the Laws of the Republic of Kazakhstan, with the Decrees of the Government of the Republic of Kazakhstan, with other normative legal acts, with the given Regulation and the Regulation of the city's akimat.
1.3. The founder of the Machinery is the Akimat of Shymkent (hereinafter referred to as "The Founder"). Constituent document of the Machinery is the given Regulation.
1.4. The Machinery is a legal entity- a state institution, in accordance with the Legislation of the Republic of Kazakhstan, has separate balance, rated and other accounts in banks, the right to carry out exchange operations, blanks with its name in the state language: "Shymkent kalasynyn akymy apparaty", in Russian language: "Apparat akima goroda Shymkentа".
1.5. The Machinery enters into civil and legal relations from its own name.
1.6. The Machinery has a right to enter as a party of the civil and legal relations in the name of the akim and akimat of the city, if it is authorized to do it in accordance with the legislation.
1.7. Location of the Department is Shymkent city, Tynybaev Street,49.
1.8. The full name of the Machinery is: - in the state language: "Shymkent kalasynyn akymy apparaty", in Russian language: "Apparat akima goroda Shymkentа".
1.9. The Machinery activity is financed from the city budget.
II. The main tasks, functions, rights and obligations of the Machinery
2.1. The main task of the Machineryis informational-analytic, organizational-legal and material-technical provision of an activity of akimat and akim of Shymkent.
2.2. In accordance with the main task, the Machinery executes the following functions:
1) a provision of the timely execution of: the Laws of the Republic of Kazakhstan, Acts of the President of the Republic of Kazakhstan, Decrees of the Government of the Republic of Kazakhstan, decrees of the regional and city akimats, decisions and orders of the city akim, taking measures on elimination of revealed violations, reasons and conditions of their non-execution;
2) a consecutive realizationof the strategy "Kazakhstan-2030", tasks, followed from the annual "Addresses of the President of the Republic of Kazakhstan to the people of Kazakhstan", analysis of social and economic development, a decision of important problems of the city.
3) an interaction with the Machinery of the South-Kazakhstan region's akim, with the maslikhat of Shymkent.
4) a carrying out of an activity analysis of the executive bodies, financed from the city budget, of akims of city districts on execution of the state and regional programmes, an activity plan of the city akim, making recommendations and proposals on improvement of state of affairs;
5) an activity coordination of the state organs on enforcement of lawfulness, law and order, on development of a mechanism of social and lawful protection of natural and legal persons, independently from the form of property, an elaboration of measures on strengthening of the state discipline and public order in the city;
6) an activity coordination of the state and non-state structures of the city on provision of stability, international agreement and consolidation of society;
7) a provision of the city akim with information-analytic materials on the problems of the social and political situation in the city, a studying of public opinion about economical and social conversions, carried out in the city, an elaboration of measures on prevention and overcoming of negative phenomena in economical and social life, a monitoring of social reforms;
8) a preparation of the projects of the city akimat's decrees, of the decisions and orders of the city akim , their legal expertise;
9) an elimination of the activity of akimat and akim of the city in mass media, an organization of an interaction with mass media, an explanation of social and economical policy among the population by the akim of the city;
10) an organization of the city akim's interaction with the local representative organ, with public and religious associations, an elaboration of common measures on further promotion of social and political stability in the city, of international agreement;
11) an execution of personnel selection, a formation of personnel reserve, appointed by the akim of the city, a drawing up of materials on their appointment to a post and dismissing from a post, an organization of studying of the government officials and an improvement of their qualification;
12) a provision of carrying the measures with participation of the akim of the city;
13a documentation provision of activity of the akimat and akim of the city, an examination of official documents, letters and applications, an organization of reception, including the place of work and location, an analysis of flow of documents, a development of an office work, an improvement of the style and methods of work;
14) a decision questions of social protection of officials of the Machinery, in accordance with the established procedure.
2.3. For execution of its tasks and functions, in accordance with the procedure established by the Legislation of the Republic of Kazakhstan, the Machinery, within its competence, has right:
1) to require and to receive from the state organs, district akims a necessary information, and also to give, within its competence, instructions, obligatory to be executed;
2) to make inspection of execution of acts and orders of the President of the Republic of Kazakhstan, of the Government of the Republic of Kazakhstan, of the region's akim, decrees of the akimat of the region and of the city, decisions, orders of the akim of the city, his deputies, taking measures on elimination of revealed violations, reasons and conditions of their non-execution;
3) to use information data banks which are available to the state organs;
4) to use the state transport equipments, connection and communication systems;
5) to draw to the work the scientific institutions, scientists and specialists, representatives of law-enforcement and controlling bodies, including in contractive base;
6) to make suggestions to the akim of the city about an appointment to a post and dismissing from a post of the akims of the city districts, chiefs of the executive organs, financed from the city budget, and also to call them to a disciplinary responsibility;
7) to make suggestions to the akim of the city about an improvement of activity of executive organs financed from the city budget;
8) to take part in meetings of the city's akimat, in conferences hold by the akim of the city and by his deputies;
9) to conduct correspondence with state and non-state organs, organizations on problems referred to holding the Machinery;
10) to draw officials of the Machinery, of the city executive organs, of representatives of enterprises and organizations to participation in preparation and decision of problems considered by the akimat and the akim of the city;
2.4. Obligations of the Machinery are regulated by the current Legislation of the Republic of Kazakhstan.
III. Management of the Machinery
3.1. General management of the Machinery is realized by the akim of the city.
3.2. In accordance with the Legislation of the Republic of Kazakhstan, the akim of the city appoints a Head of the Machinery and gives him/her the following authorities:
A Head of the Machinery:
1) organizes and leads a work of the Machinery, assumes a responsibility for execution of the tasks laid on the Machinery, and execution of its functions;
2) acts on the principles of unified management and independently decides the problems of the Machinery activities, in accordance with its competence, determined by the Legislation of the Republic of Kazakhstan and the given Regulation;
3) acts in the name of the Machinery without warrant;
4) represents the interests of the Machinery in all organs and organizations;
5) in cases and within the limits, established by the Legislation, manages the property of the Machinery;
6) gives instructions, obligatory for execution by the officials of the Machinery;
7) represents to the akim of the city the projects of akimat's decrees, decisions and orders of the akim of the city and other materials;
8) develops projects of Regulation of the Machinery, and submits them to the akimat of the city for approval;
9) executes an administration of formulation of the qualifying requirements to the administrative state positions and signs official documentations for directing the decision about their approval for registration in the organs of justice;
V. An order of making changes and additions to the given Regulation.
VI. Reorganization and liquidation of the Machinery
6.1. Reorganization and liquidation of the Machinery is produced in the following cases: - according to the decision of the Founder; on the basis of a decision of the Court; in other cases, established by the current legislation.
10) coordinatesa work of structural subdivisions of the Machinery on execution of acts of the President of the Republic of Kazakhstan, of the Government of the Republic of Kazakhstan, of decreesof the regional, city akimats, of decisions and orders of the akimats of the region and city;
11) makes suggestions to the city's akim about an awarding of a prize, about an official premium and about an imposition of disciplinary penalty on state officials;
12) submits to the akim of the city for approval of a staff structure of the Machinery and a regulation about its structural subdivisions;
13) submits to the akim of the city for approval of a regulation about structural subdivisions of the Machinery;
14) signs official documentations within the competence of a Head of the Machinery;
15) executes other functions, laid on it by the legislation, by the akim of the city and by the given Regulation.
V. Property of the Machinery
4.1. The Machinery has an isolated property on the right of day-to-day management.
4.2. Property of the Machinery is formed for account of the property, passed to it by the Government and consists of the main funds and current funds, and other property, the price of which is shown in balance of the Machinery.
4.3. Property, assigned to the Machinery, refers to the state communal property of the city.
4.4. The Machinery has no right to alienate independently or manage the property assigned to it.
V. An order of making changes and additions to the given Regulation.
5.1. Changes and additions to the given Regulation are passed on the basis of the Founder's decision.
5.2. Introduced changes and additions to the given Regulation are subject to the state registration in the organs of justice, in accordance with the Legislation of the Republic of Kazakhstan.
VI. Reorganization and liquidation of the Machinery
6.1. Reorganization and liquidation of the Machinery is produced in the following cases: - according to the decision of the Founder; on the basis of a decision of the Court; in other cases, established by the current legislation.
6.2. Liquidation is considered to be completed, and the Machinery suspends its activity since the moment of making entries about it in the state register of legal entities.
6.3. After liquidation the property is passed into the hands of the Founder.
